ALERT: DOPL to temporarily suspend enforcement of e-prescribing requirements under Utah Code Section 58-37-22

Beginning January 1, 2022, the Utah Code requires most prescriptions for controlled substances to be issued electronically (e-prescribing). (See Utah Code Section 58-37-22, 2020 H.B. 177, and  2021 H.B. 265.)

After visiting with legislative sponsors and other stakeholders on the status of e-prescribing, and in light of recent Centers for Medicare & Medicaid Services (CMS) statements, the Division of Occupational and Professional Licensing will temporarily suspend enforcement of the electronic prescription requirement in Section 58-37-22. Until further notice from the Division, pharmacies in Utah may continue to honor written or verbal legal prescriptions.

This temporary suspension is effective January 1, 2022, and will remain in effect until amendment of this notice.  During this time, the Division strongly encourages each pharmacy to contact their software vendor and test their system functionality for compliance with the requirements of Section 58-37-22.
